1. Agreement to these terms

These Terms & Conditions ("Terms") govern your access to and use of AI Website Creation and the related websites, apps and services (together, the "Service"). By creating an account, starting a free trial, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

If you use the Service on behalf of a business, you confirm that you are authorised to accept these Terms for that business.

2. Who we are

3. Definitions

• "Account" means the account you create to use the Service.
• "Brand Assets" means the names, logos, text, images, websites and other output you generate with the Service.
• "Your Content" means anything you upload, enter or provide, including prompts, briefs and files.
• "Plan" means the subscription tier you select, such as Solo, Business or Agency.

4. Eligibility and your account

You must be at least 18 years old, or the age of majority where you live, to use the Service. You are responsible for the information you give us being accurate and kept up to date.

You are responsible for keeping your login details safe and for all activity under your Account. Tell us promptly if you believe your Account has been used without your permission.

5. Free trial

We offer a 14 day free trial so you can try the Service before you pay. No credit card is required to start the trial.

During the trial some features or usage limits may apply. When the trial ends you can choose a paid Plan to continue. If you do not subscribe, your access to paid features stops and your Account may be paused.

6. Plans, pricing and taxes

Prices are shown on our Pricing page in pounds sterling (GBP) and can be billed monthly or yearly. Yearly billing is charged once for the year. The features and usage limits of each Plan are described on the Pricing page.

Prices are shown exclusive of tax unless stated otherwise. Value Added Tax (VAT) at the applicable rate is added where required by law and shown on your invoice.

We may change our prices and Plans. If a change affects your active subscription, we will give you reasonable notice before it applies to your next renewal.

7. Payment and renewal

Paid Plans are subscriptions that renew automatically at the end of each billing period (monthly or yearly) using your chosen payment method, until you cancel. By subscribing you authorise us and our payment providers to charge the applicable fees and taxes.

If a payment fails, we may retry it and may suspend paid features until payment is received. You are responsible for keeping your payment details valid.

8. Cancellation and refunds

You can cancel your subscription at any time from your Account settings. Cancellation stops the next renewal. Your Plan stays active until the end of the period you have already paid for, and it is not renewed after that.

Except where the law requires otherwise, payments already made are non-refundable, including for partial periods or unused usage. If you think you have been charged in error, contact us and we will look into it.

9. Your content and your brand assets

You keep ownership of Your Content. As between you and us, you also own the Brand Assets you generate with the Service, and you can export them and connect your own domain. We do not lock your brand in.

You grant us the limited rights we need to run the Service, such as storing, processing and displaying Your Content and Brand Assets to provide, secure and improve the Service. You are responsible for having the rights to anything you upload.

10. AI-generated output

The Service uses artificial intelligence to generate names, logos, copy, websites and other assets. AI output can contain mistakes, may not be unique, and may resemble existing material. You are responsible for reviewing everything before you use it.

In particular, we do not guarantee that a generated name, logo or domain is available, registrable, or free from third-party rights. Before you use a brand name or logo commercially, carry out your own trademark and availability checks or take professional advice.

11. Acceptable use

You agree not to misuse the Service. In particular, you will not:

• break the law or infringe anyone else's rights, including intellectual property or privacy;
• create content that is unlawful, deceptive, hateful, or that impersonates another person or brand;
• attempt to break, overload, reverse engineer or gain unauthorised access to the Service;
• resell or redistribute the Service except as expressly allowed by your Plan.

We may remove content or limit use that we reasonably believe breaks these rules.

12. Our intellectual property

The Service itself, including the software, the AI Website Creation brand, and the design of the platform, belongs to us or our licensors. These Terms do not give you any rights in the Service other than the right to use it under your Plan.

13. Third-party services

The Service relies on third parties, for example for payments, hosting, domains and AI models. Your use of those services may be subject to their own terms. We are not responsible for third-party services we do not control.

14. Availability and changes to the Service

We work to keep the Service available and reliable, but we do not promise it will be uninterrupted or error free. We may add, change or remove features, and we may carry out maintenance that briefly interrupts the Service.

Some features may be offered as previews or be described as planned or on the roadmap. Those features are not guaranteed, may change, and should not be relied on until they are released.

15. Disclaimers

The Service and all output are provided on an "as is" and "as available" basis. To the extent permitted by law, we disclaim all warranties that are not expressly set out in these Terms, including fitness for a particular purpose and non-infringement. You use the Service and its output at your own discretion and risk.

16. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental or consequential loss, or for lost profits, revenue, data or goodwill. Our total liability to you for any claim relating to the Service is limited to the amount you paid us for the Service in the three months before the event giving rise to the claim.

Nothing in these Terms limits liability that cannot be limited by law.

17. Indemnity

You agree to cover reasonable losses and costs we incur from a third-party claim that arises because you broke these Terms, misused the Service, or used output in a way that infringed someone else's rights.

18. Suspension and termination

You can stop using the Service and close your Account at any time. We may suspend or end your access if you seriously or repeatedly break these Terms, or if we must do so to comply with the law or protect the Service or other users.

When your Account ends, your right to use the Service stops. Where reasonable, we will give you a chance to export your Brand Assets first. We may delete your data after a reasonable period, subject to law.

19. Governing law

These Terms are governed by the laws of England and Wales, without regard to conflict of law rules. Mandatory consumer protection rights you have where you live are not affected.

20. Changes to these terms

We may update these Terms from time to time. If we make a material change, we will take reasonable steps to let you know, for example by email or a notice in the Service. Continuing to use the Service after a change takes effect means you accept the updated Terms.
